York Village Dental Employment Terms and Conditions
These Employment Terms and Conditions (“Agreement”) set forth the general terms applicable to employment with York Village Dental (“the Practice”) located in York, Maine. All employees are expected to read, understand, and agree to the following terms as a condition of employment.
1. Employment Classification
All team members are classified as W-2 employees of York Village Dental. This means that the Practice is responsible for withholding federal and state taxes, Social Security, and other applicable payroll deductions as required by law.
2. Work Schedule
Standard office hours are Monday through Friday, 8:00 a.m. to 5:00 p.m. Employees are expected to be present and ready to begin work at the start of each scheduled shift. Actual schedules may vary depending on patient needs, staff availability, or clinical requirements. Any changes to hours or shift assignments will be communicated in advance when possible.
3. Compensation
Compensation will be determined at the time of hire and outlined in a formal offer letter. Pay is based on the position hired for, experience, and qualifications. All compensation is subject to applicable taxes and deductions as required by law.
4. Benefits
Details regarding benefits—including but not limited to paid time off, health or dental insurance, holidays, and other employment-related benefits—will be discussed and provided during the formal employment interview process. Eligibility and participation in any benefit plan are subject to the terms of those plans and applicable waiting periods.
5. Probationary Period
All new employees shall serve a ninety (90) day probationary period beginning on the first day of employment. During this period, either the employee or the Practice may terminate employment at any time without cause and without further obligation, other than payment for hours worked. Upon successful completion of the probationary period, the employee will be considered a regular employee of the Practice.
6. Licensure and Professional Requirements
All clinical employees, including dental hygienists and dental assistants, must maintain current and active licensure and certifications as required by the Maine Board of Dental Practice. This includes maintaining valid CPR certification and completing continuing education requirements. Failure to maintain such credentials is grounds for immediate termination.
7. Confidentiality and HIPAA Compliance
Employees shall maintain strict confidentiality regarding all patient information, business operations, pricing, and proprietary data. Disclosure of patient health information is strictly prohibited except as authorized by the Health Insurance Portability and Accountability Act (HIPAA) and applicable state law. Employees will be required to sign a separate HIPAA and Confidentiality Agreement upon hiring.
8. Non-Solicitation and Non-Compete
For a period of twelve (12) months following the end of employment, employees agree not to directly or indirectly solicit patients, staff, or vendors of York Village Dental for personal or business gain. Employees also agree not to engage in or assist with any competing dental practice within a reasonable geographic area (typically within ten [10] miles of York Village Dental) for a period of one (1) year, subject to compliance with Maine employment law.
9. Termination of Employment
Either party may terminate employment at any time by providing a minimum of two (2) weeks’ written notice. The Practice reserves the right to terminate employment immediately for cause, including but not limited to misconduct, breach of confidentiality, violation of state or federal law, loss of licensure, or repeated failure to perform job duties.
10. Workplace Conduct
Employees are expected to conduct themselves in a professional, respectful, and ethical manner at all times. York Village Dental maintains a zero-tolerance policy for harassment, discrimination, or unprofessional behavior. All employees must comply with the policies and procedures outlined in the York Village Dental Employee Handbook.
11. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed under the laws of the State of Maine. In the event of a dispute arising under these Terms and Conditions, both parties agree to make reasonable efforts to resolve the matter through informal discussion or mediation prior to pursuing any legal action.
12. Acknowledgment
By accepting employment with York Village Dental, the employee acknowledges that they have read, understood, and agree to comply with these Terms and Conditions, along with all other practice policies, procedures, and applicable laws.
